Distance Sales Agreement

This framework applies where an EU consumer concludes an online sale with a professional trader through BidArch. The transaction-specific listing, checkout summary, seller identity and confirmation form part of the agreement.

2. Contracting seller
The listing and checkout must identify the contracting seller, geographic address, email, trader/private status and, where applicable, registration and VAT details. If the seller is private, EU consumer rules that apply only to trader-to-consumer contracts may not apply.
3. Goods and total price
The listing states the main characteristics, authorship or attribution, material, dimensions, condition and known defects where relevant. Checkout displays the item or hammer price, buyer premium, handling charge, tax, delivery and the total payable before the buyer places an order carrying a payment obligation.
4. Formation and confirmation
A bid is an offer under the applicable auction rules. A fixed-price order is placed through checkout. The sales contract is concluded at the point described in the transaction-specific rules. Confirmation and the applicable terms are provided in a durable medium, such as email or a downloadable account record.
5. Payment
Permitted methods, timing and any lawful method-specific cost are displayed before order placement. Never transfer funds to account details received only through an unsolicited message; verify them against the authenticated invoice or checkout.
6. Delivery
Available destinations, methods, charges and estimates are shown at checkout. Unless otherwise agreed, consumer goods must be delivered without undue delay and within the legally applicable period. Risk generally transfers when the consumer or a designated person physically receives the goods.
7. Withdrawal
An eligible consumer generally has 14 days from physical receipt of goods to withdraw without giving a reason. Online-only bidding is not treated as excluded merely because it is described as an auction. The process, model notice and lawful exceptions are set out in the Returns & Refunds Policy.
8. Conformity and legal guarantee
Mandatory remedies apply if goods supplied by a professional trader are not as agreed, including where they are materially misdescribed, damaged before delivery or not authentic as represented. Depending on the circumstances, remedies may include bringing goods into conformity, replacement, price reduction or contract termination and refund. Mandatory national periods are not reduced by this agreement.
9. Complaints and disputes
Complaints may be sent to info@bidarch.com. Consumers retain access to competent courts and any applicable national consumer ADR body. A choice-of-law clause cannot remove mandatory protection of the consumer's habitual-residence country.
