User Agreement

These terms govern use of BidArch. Additional auction-house or seller terms may apply to a particular sale, but they cannot remove mandatory rights granted to a consumer by applicable EU or national law.

2. Eligibility and accounts
- You must be at least 18 and legally capable of entering a contract.
- Account and verification information must be accurate and kept current.
- You are responsible for protecting your credentials and promptly reporting misuse.
- Identity, sanctions, anti-fraud or business verification may be required.
3. BidArch's marketplace role
The relevant listing identifies the seller and whether that seller acts as a professional trader or private individual. It also states whether BidArch, an auction-house partner or another seller concludes the sales contract. Consumer protections may differ when buying from a private seller.
4. Listings and bids
- Material characteristics, condition information and known restoration must be stated as accurately as reasonably possible.
- A submitted bid is a binding offer, subject to the sale rules and mandatory law.
- Shill bidding, price manipulation, impersonation and unlawful listings are prohibited.
- Obvious clerical or technical errors may be corrected fairly before a contract is concluded.
5. Prices and payment obligation
Before an order is placed, checkout displays the price or hammer price, buyer premium, handling charge, applicable taxes, delivery cost and total. The final order control must clearly indicate that placing the order creates an obligation to pay. No unannounced charge is payable.
6. Payment, delivery and risk
Available payment and delivery methods are shown before checkout. For consumer sales, risk remains with the trader until the consumer or a person designated by the consumer takes physical possession, except where the consumer independently commissions a carrier not offered by the trader.
7. Withdrawal, returns and conformity
The Returns & Refunds Policy forms part of these terms. Eligible consumers generally have a 14-day withdrawal right for online distance contracts with professional traders. Statutory remedies for goods that are damaged, counterfeit, misdescribed or otherwise non-conforming remain available.
8. Suspension and termination
BidArch may proportionately restrict an account to protect users, comply with law or investigate serious misuse. Where appropriate, reasons and an opportunity to challenge the decision will be provided. You may request account closure, subject to outstanding transactions and lawful retention duties.
9. Intellectual property and acceptable use
BidArch software, branding and original editorial content are protected by intellectual-property law. Limited personal research use is permitted. Security attacks, unlawful scraping, rights infringement and circumvention of access controls are prohibited.
10. Liability
Nothing in these terms excludes liability or remedies that cannot lawfully be excluded, including liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or mandatory consumer guarantees. Any other limitation applies only to the extent permitted by applicable law.
11. Governing law and disputes
The governing law stated for a transaction does not deprive an EU consumer of mandatory protections of the country where the consumer habitually resides. Consumers may contact info@bidarch.com first and may also use competent national consumer-protection or alternative-dispute-resolution bodies where available.
12. Changes
The version accepted for a completed transaction remains available with that transaction. Material prospective changes will be communicated reasonably and will not retroactively reduce accrued rights.
